01 Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the Tikel mobile application, website, support channels, pilots, beta programs, and related services provided by Abhishaan Labs ("Tikel," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

02 Eligibility

You may use the Services only if you are legally capable of entering into a binding agreement and are not prohibited from using the Services under applicable law. If you are below the age of digital consent or contractual capacity in your jurisdiction, you may use the Services only with valid parent or guardian involvement where required. Tikel is not directed to young children.

03 What Tikel provides

Tikel provides food logging, food scanning, packaged-product analysis, nutrition summaries, recipes, pantry tools, meal planning, chat-based assistance, voice logging, subscriptions, and related wellness-support features. Certain features may rely on AI, OCR, speech systems, analytics, cloud infrastructure, and third-party providers.

Tikel may offer free, paid, trial, beta, pilot, or premium features. Feature availability, limits, credits, caps, supported foods, supported languages, and plan benefits may vary by plan, region, device, platform, and version.

Tikel is not a medical service, doctor, hospital, dietitian, emergency response service, or regulated medical device. The Services do not diagnose, treat, cure, or prevent disease and do not replace professional medical advice.

Nutrition, ingredient, recipe, plan, allergy, menstruation/cycle, skincare/haircare, athlete, or wellness outputs are informational and may be estimated.

Consult a qualified professional before making medical, allergy-sensitive, pregnancy-related, eating-disorder-related, surgery recovery, chronic-condition, medication, or emergency decisions. In an emergency, contact local emergency services immediately.

06 Permissions and user responsibility

Features such as food scanning, image upload, voice logging, notifications, and future health-platform integrations may require permission to access camera, selected photos/media, microphone, notifications, location, or health data. You may deny permissions, but some features may not work fully without them.

You are responsible for reviewing scans, AI outputs, ingredient warnings, recipes, and logs before relying on them. You are also responsible for any food sourcing, cooking, storage, consumption, and allergy-safety decisions you make.

08 User Content

You may submit text, images, audio, recipes, food logs, pantry items, preferences, corrections, feedback, ratings, and other materials ("User Content"). You retain ownership of your User Content, subject to the rights granted below.

You grant Tikel a worldwide, non-exclusive, revocable where legally required, royalty-free license to host, store, reproduce, process, adapt, display, analyze, and use your User Content as reasonably necessary to operate, secure, improve, personalize, and support the Services. This includes processing by service providers acting on our behalf. We do not claim ownership of your User Content.

You represent that you have the rights needed to submit your User Content and that doing so does not violate any law, third-party rights, or platform terms. If you import or paste recipes from external websites, videos, reels, or social platforms, you are responsible for ensuring you have the right to use that content.

09 AI features and estimated outputs

Tikel may use internal and third-party AI, OCR, speech, and analytics systems to produce outputs. Outputs may be incomplete, approximate, biased, unavailable, or wrong. Estimated outputs include food recognition, ingredient flags, nutrition summaries, macros, substitutions, recipe evaluations, meal suggestions, plan guidance, chat responses, and voice transcripts.

Tikel may provide correction, confirmation, or regeneration options. You are responsible for reviewing results, especially where allergies, medical conditions, pregnancy, surgery recovery, eating disorders, athlete needs, or other health-sensitive circumstances are involved.

10 Food scans, labels, OCR, and allergens

Food scans and label analysis depend on image quality, lighting, packaging, serving size, OCR accuracy, databases, and user corrections. Tikel may fail to detect an allergen, ingredient, contaminant, cooking method, oil type, additive, or portion size. Never rely solely on Tikel for allergy or medical safety. Always read actual product labels, restaurant information, and professional advice where relevant.

11 Plans, recipes, user recipes, and pantry suggestions

Meal plans, recipes, user-submitted recipe checks, and pantry suggestions are generated from information you provide and may rely on assumptions. If you submit your own recipe, output may be approximate unless you provide complete ingredients, quantities, servings, preparation steps, oil/ghee/sugar/salt amounts, and cooking method.

Tikel may suggest modifications, substitutions, warnings, or alternatives. You remain responsible for final cooking, ingredient sourcing, storage, preparation, consumption, and suitability decisions.

12 Human experts, coaches, partners, or meal delivery

If Tikel later offers human coaches, dietitians, trainers, nutritionists, restaurant partners, food vendors, marketplace features, or physical meal delivery, those services may be subject to separate terms, licenses, refund policies, delivery policies, merchant terms, food safety responsibilities, and professional disclaimers. Unless expressly stated, Tikel is not responsible for third-party providers, restaurants, marketplaces, couriers, or food-preparation decisions outside the app.

13 Subscriptions, billing, renewals, and refunds

Some features may require a paid subscription, credit pack, or one-time purchase. Paid plans, limits, billing interval, trial terms, renewal terms, cancellation method, and benefits must be clearly displayed before purchase.

Apple App Store and Google Play purchases: billing, cancellation, renewal, taxes, refunds, and restore-purchase rights are generally handled by the relevant platform and subject to platform rules.

Direct purchases, if available and allowed: you authorize us or our payment provider to charge applicable fees and taxes. Direct purchase flows must comply with app-store rules and applicable law.

Auto-renewal: subscriptions may renew automatically unless cancelled before renewal through the relevant purchase channel.

Plan changes: we may change prices, limits, credits, supported features, or plan benefits prospectively and will provide notice where required.

Refunds: unless required by law or platform rules, fees may be non-refundable once charged. Platform purchases must generally be managed through that platform.

Restore access: where required by platform rules, restorable purchases must include a restore mechanism.

Physical goods / services: if future meal delivery or offline services are offered, payment, cancellation, delivery, refund, and food-safety terms may differ and will be provided separately.

14 Trials, pilots, and beta features

We may offer trials, pilots, alpha/beta features, invite-only programs, or experimental tools. These may change, malfunction, be limited, or be discontinued at any time. Unless expressly stated otherwise, beta or pilot features are provided as-is and may not have the same support levels as general-release features.

15 Future wellness modules

If Tikel later launches assistant/avatar features, menstruation or cycle-aware nutrition support, skincare/haircare-related support, wearable integrations, or similar modules, those features may be governed by supplemental terms, disclosures, and consents. If supplemental terms conflict with these Terms, the supplemental terms control for that feature.

16 Intellectual property

The Services, including the app, software, branding, graphics, interfaces, content, databases, designs, and underlying technology, are owned by or licensed to Tikel and protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services except as permitted by law or with our prior written consent.

17 Third-party services and content

The Services may rely on or link to third-party services such as AI providers, OCR providers, speech-to-text providers, cloud platforms, app stores, payment processors, social login providers, recipe sources, websites, or marketplaces. Third-party services may have their own terms and privacy policies. Tikel is not responsible for third-party terms, availability, accuracy, or conduct except as required by law.

18 Privacy

Your use of the Services is governed by our Privacy Policy, which explains how we collect, use, share, retain, and delete data. By using the Services, you acknowledge that you have read the Privacy Policy.

19 Suspension and termination

We may suspend, restrict, or terminate access if we reasonably believe you violated these Terms, created legal/security risk, misused the Services, failed to pay fees, caused harm, or where continued service is not feasible. You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including user content licenses needed for lawful retention, payment obligations, intellectual property, disclaimers, limitations of liability, indemnity, and dispute terms.

20 Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation. We do not warrant that the Services will always be uninterrupted, secure, or free of mistakes.

21 Limitation of liability

To the maximum extent permitted by law, Tikel and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss of goodwill arising from or related to the Services. To the maximum extent permitted by law, our aggregate liability for claims arising out of or related to the Services will not exceed the greater of (a) the amount you paid us for the Services during the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where such exclusion is prohibited by law.

22 Indemnity

You agree to defend, indemnify, and hold harmless Tikel and its affiliates, officers, employees, contractors, and licensors from claims, losses, liabilities, damages, judgments, and expenses arising out of or related to your User Content, misuse of the Services, violation of these Terms, violation of law, or violation of third-party rights.

23 Governing law and dispute resolution

These Terms are governed by the laws of India, excluding conflict-of-law rules, unless applicable consumer law requires otherwise. The courts located in Kolkata will have exclusive jurisdiction unless a different forum is required by applicable law. If you are a consumer, mandatory rights under the law of your usual residence may still apply.

24 Changes to the Services or these Terms

We may change the Services or these Terms from time to time. If we make material changes, we will provide notice through the app, website, email, or other reasonable means where required. Your continued use after updated Terms take effect means you accept the revised Terms unless applicable law requires a different method of acceptance.
